Is user consent required for the application of cookies on their terminal equipment?

It depends on the purposes for which the cookies are used and, therefore, whether they are "technical" or "profiling" cookies.
For the installation of technical and analytics cookies, the users' consent is not required, while it is always necessary to provide information (art. 13 of EU Regulation 2016/679).
Profiling cookies or other tracking tools, on the other hand, may only be used if the user has given consent after being informed by simplified means.

As established by the Supervisor in the provision of 8 May 2014 and restated in the Guidelines for cookies and other tracking tools of 10 June 2021, the information should be set up on several levels and may also be made on several channels, adopting all appropriate measures to make it accessible without discrimination to subjects with disabilities.

While respecting the accountability of the owner and therefore their freedom to choose the measures and solutions that best ensure compliance with legal obligations, the Supervisor, however, suggests the adoption of a mechanism whereby, when the user accesses a website (on the home page or any other page), a banner immediately appears containing a first 'short' notice, the request for consent to the use of cookies and a link to access a more 'extensive' notice. On this page, the user will find further and more detailed information on cookies and will be able to choose which specific cookies to authorise.
Therefore, since this site mainly deals with technical cookies, consent is not required.


Consent
In order to keep track of the consent acquired, the owner of the site may use a specific technical cookie, a system that is not particularly invasive and which does not in turn require further consent, as well as other methods that allow the records of the data subject's choices to be kept up to date.
It remains possible for the user to easily change his options at any time. In this regard, it is good practice to adopt a technical device (such as an icon or a graphic sign) indicating at any time the status of the consents previously given by the user.
The mere scrolling of the page cursor is not in itself a suitable act for expressing informed consent.
